1. Acceptance of Terms

By accessing and playing Mansion of the Shallow Ground ("the Game"), you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not play the Game.

2. Age Restriction

The Game is intended exclusively for adults aged 18 years and over. By confirming the age gate, you represent and warrant that you are at least 18 years old. We reserve the right to terminate access if we have reason to believe a user is under 18.

3. Content Warning

Mansion of the Shallow Ground contains:

• Explicit adult content including textual descriptions of sexual scenarios
• Gothic, industrial, and fetish-adjacent aesthetics
• LGBTQ+ characters and themes (non-binary characters, same-sex relationships)
• Mature themes including power dynamics, consent (explicitly depicted as positive)
• Strong language and dark humour

All intimate encounters depicted in the Game are between consenting adult characters. The Game actively models enthusiastic consent as a core narrative value.

4. Intellectual Property

The Game, including all artwork, music, dialogue, code, and narrative content, is the intellectual property of BMSG. The music tracks featured in the Game are original compositions by BMSG and are protected by copyright. Unauthorised reproduction, distribution, or modification is prohibited.

5. Music Licensing

The eleven BMSG original tracks included in the Game (including "My Last Dance", "Mine Tyme Hath Come", and "Burn My Shallow Ground") are licensed for in-game use only. They may not be extracted, redistributed, or used outside the context of the Game without explicit written permission from BMSG.

6. User Data

Game progress is saved locally in your browser's localStorage. If you opt in to email marketing, your email address is stored securely and used only as described in our Privacy Policy. We do not sell personal data.

7. Disclaimer of Warranties

The Game is provided "as is" without warranty of any kind. BMSG makes no representations regarding uninterrupted access, freedom from errors, or suitability for any particular purpose.

8. Governing Law

These Terms are governed by the laws of the Federal Republic of Germany. Any disputes shall be subject to the exclusive jurisdiction of the courts of Germany.

9. Changes to Terms

BMSG reserves the right to update these Terms at any time. Continued use of the Game following notification of changes constitutes acceptance of the updated Terms.

Data Controller

BMSG ("we", "us", "our") is the data controller for personal data collected through Mansion of the Shallow Ground. We are committed to protecting your privacy in compliance with the EU General Data Protection Regulation (GDPR).

What Data We Collect

Game State (localStorage — stored on your device only):

• Game progress: inventory, flags, visited rooms, reputation score
• This data never leaves your device unless you explicitly request sync

Optional: Account Data (only if you sign in with Google):

• Your Google display name and email address
• A unique account identifier (Firebase UID)
• Sign-in timestamp

Optional: Marketing Email (only if you explicitly consent):

• Your email address
• Marketing consent timestamp and source
• Music preference indicators (which tracks you heard in-game)

Legal Basis for Processing

• Consent — for email marketing and optional account creation
• Legitimate interests — for anonymous analytics to improve the Game

How We Use Your Data

• To provide and personalise your game experience
• To send you updates about BMSG music releases (only with your consent)
• To inform you of new game content and features (only with your consent)
• We do NOT use your data for third-party advertising
• We do NOT sell, rent, or trade your data

Email Marketing — Your Rights

If you opted in to email marketing:

• You can unsubscribe at any time via the link in any email
• You can request deletion of your data by emailing dominic.veit@burnmyshallowground.com
• We will remove you within 72 hours of request

Google Sign-In (Firebase Authentication)

If you choose to sign in with Google, we use Firebase Authentication (Google LLC). Google's privacy policy applies to the authentication process. We receive only your display name, email address, and unique identifier — nothing else from your Google account.

Data Retention

• Local game saves: retained until you clear browser storage
• Account data: retained until you delete your account
• Marketing email: retained until you unsubscribe or request deletion

Your GDPR Rights

Under GDPR, you have the right to: access your data, correct inaccurate data, request deletion, restrict processing, data portability, and to withdraw consent at any time. To exercise these rights, contact dominic.veit@burnmyshallowground.com.

Cookies

The Game uses no tracking cookies. We use only essential browser localStorage for game saves. If you sign in with Google, Firebase may set authentication cookies — these are covered by Google's cookie policy.
